Effective date: October 2, 2026

Have a Moonode Wallet card? Its terms of use and privacy policy are on their own page.

Welcome to Moonode

Moonode (the "Platform") includes our website, mobile apps, dashboard, digital signage products (including Deen Screen and Canvas Screen) and related services for communities, mosques and organizations.

These Terms of Use and this Privacy Policy (together, the "Agreement") govern your use of the Platform. By creating an account, checking an acceptance box or continuing to use the Platform after we post changes, you accept this Agreement.

TERMS OF USE

Please read carefully. This Agreement is between you ("you", "User" or "Customer") and the Moonode company identified in Section 1. "Moonode", "we" and "us" mean Moonode Inc. and Moonode LLC, as applicable. If you do not agree, do not use the Platform.

1. Who We Are

Moonode Inc. is a Quebec company based in Montreal, Quebec. It operates the Platform and provides support.

Moonode LLC, its parent company in the United States, collects online payments for Moonode Inc. through our payment processor. Its name may appear on your card statement and receipts; this does not change who provides the services.

You contract with:

• Moonode Inc., if your account, billing address or main place of use is in Canada;

• Moonode LLC, if they are outside Canada and you are not a consumer protected by mandatory Canadian law;

• the company named at checkout or in an order form, if one is expressly named there.

Contact: support@moonode.com. Postal address on request.

2. Acceptance & Language

You confirm that you have the authority to bind yourself or the organization you register.

This Agreement is available in French, English and Arabic. Where French is required by law, notably for Quebec consumers, the French version prevails. The Arabic version is a translation: if it differs, the French or English version prevails.

Electronic acceptance (checkbox, account creation or payment confirmation) is binding to the extent the law allows.

3. Accounts

You must be of the age of majority where you live to open an account. The Platform is not intended for children (see Privacy Policy, Section 13). Organization administrators are responsible for what their screens display and for their users.

Give accurate information and keep your login details confidential. Tell us at once at support@moonode.com if someone uses your account without permission.

4. License & Acceptable Use

Subject to this Agreement and your plan, we grant you a limited, non-exclusive, non-transferable and revocable license to use the Platform for your business, community or organization, including commercial digital signage under a paid or approved plan.

You may not: reverse engineer the Platform, except as the law allows; extract data without consent; resell access without authorization; upload unlawful, infringing or harmful content; get around security; or use the Platform to harass, discriminate or infringe the rights of others.

You keep ownership of your content. You grant Moonode a worldwide license to host, display, transmit and process it only to operate and improve the Platform.

5. Fees, Payment & Taxes

Paid features and their prices are shown on our website or dashboard. Prices may change at renewal, with notice where required.

Payments go through our payment processor, whose own terms also apply. Online charges, invoices and receipts may be issued by Moonode LLC (Section 1). You authorize recurring charges to your payment method until you cancel.

Applicable taxes are added unless stated otherwise. Where required, Canadian sales taxes are collected and remitted by Moonode Inc.

6. Refunds & Cancellation

Unless a written offer says otherwise, subscription fees are not refundable once a billing period has started, except where the law requires a refund or credit.

If you are a consumer, nothing in this Agreement limits the rights that consumer protection laws give you.

You can cancel a recurring subscription from the dashboard or by writing to support@moonode.com. Future charges stop, and access continues until the end of the paid period unless stated otherwise.

7. Third-Party Services

The Platform may use or link to third-party services, such as app stores, maps or payment. Their own terms apply, and we are not responsible for third-party websites.

8. Intellectual Property & Copyright

The Platform, its software, the Moonode brand and our content belong to Moonode Inc., Moonode LLC or their licensors and are protected by law. No rights are granted except as stated in this Agreement.

If you believe content on the Platform infringes your copyright, write to support@moonode.com with the subject "Copyright Notice": identify the work and the content, and give your contact details and a good-faith statement. We follow the notice procedures of Canadian and U.S. copyright law.

9. Disclaimer

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE EXTENT THE LAW ALLOWS, MOONODE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND DOES NOT PROMISE UNINTERRUPTED OR ERROR-FREE OPERATION.

Where the law does not allow a disclaimer, it applies only as far as the law allows.

10. Limitation of Liability

TO THE EXTENT THE LAW ALLOWS, MOONODE INC., MOONODE LLC AND THEIR DIRECTORS, OFFICERS AND EMPLOYEES ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL.

OUR TOTAL LIABILITY IS LIMITED TO THE GREATER OF (A) WHAT YOU PAID MOONODE IN THE 12 MONTHS BEFORE THE CLAIM AND (B) CAD $100 OR USD $100, EXCEPT WHERE THE LAW DOES NOT ALLOW THIS LIMIT, INCLUDING FOR CERTAIN CONSUMER CLAIMS.

11. Indemnification

You will defend and indemnify Moonode against third-party claims arising from your content, your breach of this Agreement or your violation of the law, except where caused by our gross or intentional fault. This section does not apply to consumers where the law prohibits it.

12. Suspension & Termination

You may stop using the Platform at any time. We may suspend or end your access for breach, security risk, non-payment or a legal requirement, with notice where practicable. Sections that by nature should survive (payment, intellectual property, disclaimer, liability, indemnification, governing law) survive termination.

13. Governing Law & Disputes

Contracts with Moonode Inc.: this Agreement is governed by the laws of Quebec and the federal laws of Canada that apply there. The consumer protection laws of your province or territory apply where they protect you more. A consumer may go to the courts where they live, and nothing in this Agreement forces a consumer into arbitration or prevents them from joining a class action. A business customer first tries to settle a dispute in good faith for 30 days, then may go to the courts of Quebec, unless agreed otherwise in writing.

Contracts with Moonode LLC: this Agreement is governed by the laws of the State of Delaware (United States), and disputes go to the courts of Delaware, subject to the mandatory protections of your place of residence. Where the law allows, a non-consumer brings claims individually, not as part of a class action.

14. Entire Agreement

This Agreement, your order forms and the policies it refers to are the entire agreement about the Platform. If a provision is unenforceable, the rest remains in effect. Not enforcing a provision is not a waiver.

15. Changes

We may update this Agreement by posting a new version with a new effective date. We announce material changes on the Platform or by email, at least 30 days in advance where the law requires it. Continuing to use the Platform after the effective date means you accept the changes, except where your express consent is required.

You can withdraw your consent to non-essential uses by writing to support@moonode.com, subject to legal or contractual limits. A sensitive or unexpected use, such as precise location or automated decisions, is explained when we collect the information and, where required, relies on your express consent.

6. Cookies & Similar Technologies

We use cookies and similar technologies for sign-in, your preferences, security and audience measurement. Our audience measurement tools load as soon as you arrive on the site: they set cookies and derive an approximate location (city or country) from your IP address. Our service providers, bound by contract: hosting, content delivery, email, push notifications, text messages (SMS), payment processing, audience measurement and customer support tools. Within Moonode, only the people who need it for their work can access it. We never sell your information.

8. Where Your Information Is Kept

Our servers are in the cloud, mainly in Europe; some files you upload are stored in the United States. Some providers, such as our payment processor or our email provider, may process information in the United States or elsewhere. Your information may therefore be communicated outside Quebec. We protect it with contractual and organizational measures suited to its sensitivity.

9. Retention

We keep personal information only as long as needed for the purposes above, our legal obligations and resolving disputes, then we delete it. Typical periods: account data while the account is active, plus up to 24 months; billing records as long as tax law requires (up to 7 years); technical logs up to 12 months, unless a security investigation requires longer.

10. Security

We use reasonable administrative, technical and physical safeguards suited to the sensitivity of the information. No method is completely secure. Report any suspected incident to support@moonode.com.

11. Your Rights

You can ask to access your information and get a copy, have it corrected or deleted, receive it in a structured, commonly used technological format, withdraw your consent, ask us to stop disseminating it, and be told about any decision based only on automated processing. Write to support@moonode.com. We answer in writing within 30 days at most, free of charge.

Complaints: write first to our person in charge of the protection of personal information. You can also contact Quebec's Commission d'accès à l'information (cai.gouv.qc.ca) or the Office of the Privacy Commissioner of Canada.

12. Marketing Messages

We send commercial emails or text messages only with your consent or as Canada's anti-spam law allows. Each one identifies us and lets you unsubscribe, and we act on it within 10 business days. Marketing consent is separate from accepting this Agreement.

13. Children

The Platform is not intended for children under 14. We do not knowingly collect personal information from a child under 14 without the consent of a parent or guardian. Write to support@moonode.com to have a child's information deleted.

14. Confidentiality Incidents

If an incident creates a risk of serious harm, we notify the people concerned and the authorities as the law requires, and we keep a register of incidents.

15. Changes to This Policy

We post updates on this page with a new effective date, and give additional notice of material changes where required.

16. Contact

Person in charge of the protection of personal information, Moonode Inc.: support@moonode.com (subject: Privacy Request)

17. How We Manage Your Information

The president of Moonode Inc. is the person in charge of the protection of personal information: he approves our rules and answers requests. Only people who need your information for their work can access it, each with a personal account, and they are trained on our rules. Every piece of information has a retention period (Section 9), after which it is deleted. We keep a register of confidentiality incidents.

18. Moonode Wallet

If you have a Moonode Wallet card, in Apple Wallet, in Google Wallet or as a web page on your phone, its terms of use and privacy policy are at moonode.com/wallet/policy.
